1. Agreement to Terms

By accessing or using Liensuite ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

These Terms apply to all visitors, users, and others who access or use the Service. By using the Service, you represent that you are at least 18 years of age and have the legal capacity to enter into these Terms.

2. Description of Service

Liensuite provides a software platform for real estate investors to manage curative title cases, access property data, and track tax delinquent and heir property opportunities in Texas. The Service includes:

  • Case management tools for tracking property deals
  • Access to aggregated public property data from Texas counties
  • Property research and analysis features
  • Data export capabilities (for paid plans)

3. User Accounts

When you create an account with us, you must provide accurate, complete, and current information. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account.

You are responsible for safeguarding your password and for all activities that occur under your account. You agree to notify us immediately of any unauthorized access or use of your account.

You may not use another user's account without permission. You may not share your account credentials with third parties.

4. Subscription and Billing

4.1 Free Tier

The free tier provides limited access to the Service, including access to Hidalgo County data and basic case management features. Free tier limitations may change at our discretion.

4.2 Paid Subscriptions

Paid subscription plans ("Pro" and "Agency") are billed in advance on a monthly or annual basis. By subscribing to a paid plan, you authorize us to charge your payment method on a recurring basis.

4.3 Cancellation

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of your current billing period. We do not provide refunds for partial months or unused portions of a subscription.

4.4 Price Changes

We reserve the right to modify subscription prices. Any price changes will be communicated to you with at least 30 days' notice before taking effect.

5. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable laws or regulations
  • Infringe upon the rights of others
  • Harass, abuse, or harm another person or entity
  • Submit false or misleading information
  • Attempt to gain unauthorized access to the Service or its systems
  • Use automated systems (bots, scrapers) to access the Service without permission
  • Interfere with or disrupt the Service or servers
  • Resell or redistribute Service data without authorization
  • Use the Service for any illegal purpose, including fraud

6. Property Data and Information

6.1 Data Sources

The property data provided through the Service is aggregated from publicly available sources, including county appraisal districts, tax assessor-collectors, and county clerks. We make reasonable efforts to ensure data accuracy but do not guarantee it.

6.2 No Warranty of Accuracy

Property data is provided "as is" without warranty of any kind. Data may be outdated, incomplete, or contain errors. You are responsible for independently verifying all information before making investment decisions.

6.3 Not Legal or Financial Advice

The Service does not provide legal, financial, tax, or investment advice. Information provided is for informational purposes only. You should consult with qualified professionals before making any real estate investment decisions.

7. Intellectual Property

The Service and its original content, features, and functionality are owned by Liensuite and are protected by copyright, trademark, and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of the Service or its content without our express written permission.

8. User Content

You retain ownership of any content you submit to the Service (case notes, documents, etc.). By submitting content, you grant us a non-exclusive, worldwide, royalty-free license to use, store, and process that content solely for the purpose of providing the Service.

You represent that you have all necessary rights to submit any content and that such content does not violate any third party's rights.

9. Termination

We may terminate or suspend your account immediately, without prior notice, for any reason, including breach of these Terms.

Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may do so through your account settings or by contacting us.

Provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY DEFECTS WILL BE CORRECTED.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LIENSUITE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify, defend, and hold harmless Liensuite and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of the Service shall be resolved exclusively in the state or federal courts located in Texas, and you consent to the personal jurisdiction of such courts.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date.

Your continued use of the Service after any changes constitutes acceptance of the new Terms. If you do not agree to the modified Terms, you must stop using the Service.
