How Tax Delinquent Property Sales Work in Arkansas
Arkansas is a tax-deed state administered centrally. Delinquent parcels are certified to the Commissioner of State Lands after roughly two years of delinquency, and after at least one more year the Commissioner auctions the land county-by-county throughout the year. The state conveys whatever interest it holds by a Limited Warranty Deed to the winning purchaser. The owner may redeem any time after certification up until 4:00 p.m. the last business day before the sale — but effective July 1, 2023, parcels sold by the Commissioner cannot be redeemed after the sale. All sales are final, both live and online. Unsold parcels then move to a continuous online 'post-auction' sale.
Bidding & Auctions
Sales are premium/highest-bid auctions with a reserve equal to the taxes, interest, penalties, and costs owed. The Commissioner holds live public auctions county-by-county, and parcels that do not sell are then offered through a continuous online post-auction sale. Because Arkansas is a pure deed state, the purchaser earns no interest — the return is the property itself, acquired at or above the minimum bid.
Redemption & Penalties
Redemption is pre-sale only. The deadline is 4:00 p.m. Central the last business day before the sale, and since July 1, 2023 there is no post-sale redemption for parcels sold by the Commissioner. However, a separate 90-day period after the sale lets prior owners or interested parties challenge the sale on notice-defect grounds, so investors are advised not to make significant improvements until it lapses. Expect a Limited Warranty — not clear — title that typically requires a quiet-title action to become marketable.
